We reserve the right, at our discretion, to modify or remove portions of these Terms and Conditions at any time. These Terms and Conditions are in addition to any other policies or other terms and conditions applicable to the web site. We do not make any representations about third party web sites that may be linked to the web site.

The My Spec website is provided for the purposes of providing quotes and taking orders from our customers, noting that:

  • Customers are persons that we will maintain a trading relationship with and we have provided with permission and access to this website. Such customers will be aware of the My Spec websites URL address.
  • Our products and/or services are for sale to adults over the age of 18 years and by using this website you acknowledge that you comply with this criteria.
  • We supply our products and services ordered through this site to customers in Australia only.
  • All prices are noted in Australian Dollars (AUD).

We will take all reasonable steps to ensure that the My Spec website is available during normal business hours (9am to 5pm Mon to Friday across Australia) and normal Saturday trading (8am to 5pm).

My Spec Site access

The website is accessed by user logons that we provide to persons that we will maintain a trading relationship with – our customers.

Customers are:

  • Responsible for keeping their logon credentials secure
  • Required to inform us if the security of their logon becomes compromised

Any loss or injury that results from customers’ inadequate maintenance of the security of their logon credentials is the responsibility of the customer.

When you access the website Global Blinds grants you a limited licence to access and use our information for the purposes of engaging in the standard commercial activities of seeking quotes and placing orders with us.

This licence does not grant rights to:

  • To use data mining or data extraction tools
  • To alter any information on the site other than that personal information that a user would be expected to maintain in the normal course of business e.g. their user profile and site preference information.
  • Metatag or mirror the website

We take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

The My Spec website and all contents remain our intellectual property

The copyright to all content on the MySpec website including applets, graphics, images, layouts and text belongs to us or we have a licence to use those materials.

Customers may download information from the website provided:

  • It is for normal commercial use between us
  • It is for the purpose of providing quotes or order information to third parties which have a bona fide trading intent with the customer for our products and/or services, or have ordered our products and/or services from the customer
  • That any copyright symbol, branding, trade mark or other proprietary notice is not changed or deleted

Except as under the Copyright Act 1968 (Cth), or noted in this section immediately above, you are not permitted to copy reproduce, republish, distribute or display any of the information on this website without our permission.

All information entered into the My Spec website becomes and remains our intellectual property. In particular we note that:

  • Any data or information provided to us through this website becomes our property and you acknowledge that you are responsible for the content of such data / information including its originality, legality and copyright.
  • You agree that we are entitled to use your data /information for any purpose without compensation – with the exceptions as detailed in our privacy policy

We make every effort to ensure that the My Spec website content is as correct and relevant as possible, but we do not warrant the information is comprehensive, complete or 100% accurate. In particular we note that:

  • Images have been provided for illustrative purposes and may not show the true colour, full design or options relating to a product
  • We reserve the right to change our website contents, prices and policies

Quotes

By providing a quote we do not warrant or make any guarantee that the product or service is currently available or will be available at the time of order.

Customers are responsible for ensuring the accuracy of any data entered in a quote. We note that:

  • Some fields related to products/services may default to certain values. This is because we either only have one option available for that item or for convenience of data entry. It is the customers’ responsibility to ensure the selections in these fields are appropriate for their needs.
  • Where we provide copy functionality it is for the convenience of reproducing certain data a second time. It is the customers’ responsibility to ensure the selections in these copied fields are appropriate for their needs.
  • For certain warning and/or error notifications it may be possible for customers to proceed without needing to change any data. Such warnings and alerts are provided as a convenient check when unusual data or selections have been entered. After being presented with a warning and/or alert it is the customers’ responsibility to ensure the selections in these copied fields are appropriate for their needs

All prices are in Australian Dollars (AUD) and our quotes will show the pre- and post- GST amounts owing if the quotes progress to an order.

Whilst we make every effort to ensure our prices are current, we reserve to change prices without notice

Orders

We will accept or reject your order within 48 hours. We will provide you with email confirmation of your order within 48 hours – if no such order confirmation is received the order will be deemed rejected and your payment refunded.

By accepting an order we do not warrant or make any guarantee that the product or service is currently available or will be available at the time of order. We will contact you within 48 hours of order receipt if there is a problem with the order to discuss how to proceed in the event of the product or service not being available.

All prices are in Australian Dollars (AUD) and all orders will show the pre- and post- GST amounts owing.

All orders need to be paid in full (including delivery charges) in order for the website to progress the order into our order fulfilment process.

A part-payment of orders may be possible through the NAB payment gateway linked to our site. When a part payment is made you will need to contact us to arrange for payment of the remainder owing or a refund of your payment less an administrative charge of $25.

Whilst we make every effort to ensure our prices are current, we reserve to change prices without notice.

When the order has been generated by converting a quote, without in any other way amending the quote, and provided the quote was generated within 14 days prior to a price change, we will honour the original quoted prices.

Delivery

Delivery charges will be noted as an additional charge, calculated at time of quote or order creation.

Delivery times will be during the standard business hours in the area in which the delivery is to be made.

Normally we require a commercial address to deliver to – but may agree to a domestic address upon request.

All deliveries must be signed for. Title for goods passes upon the delivery of the goods being signed for.

If a delivery cannot be signed for it will be returned to the logistics provider depot. It is the customers’ responsibility to arrange for the subsequent delivery of the products and any additional costs will be borne by the customer.

If the customer abandons the order by refusing to accept delivery for any reason other than the product being defective in any way, we reserve the right to deem the order as fulfilled, have the product returned to us and recover any additional costs from the customer.

Delivery Timeframes

Under the normal course of business the following delivery timeframes will apply:

  • Roller Blinds (all types): Within 28 days from date of order – usually within 21 days. Honeycomb
  • Blinds: Within 28 days from date of order Panel Glides: Within 28 days from date of order Roman
  • Blinds: Within 35 days from date of order
  • Curtains: Within 35 days from date of order
  • Drapes: Within 35 days from date of order
  • Slimline Venetians: Within 28 days from date of order
  • Timber Venetians: Within 42 days from date of order Pelmets: Within 28 days from date of order

Please note:

  • We will contact you within the week of your order being due for delivery to confirm an exact delivery date.
  • Orders will not be sent until all items are available, hence the delivery time will be that of the product with the longest lead time as noted above.
  • We reserve the right to extend the order delivery date due to production and/or import issues. If we need to delay delivery we will contact you as soon any issues become known to us.

Product Returns and Refunds

  • Due to the custom nature of our products, we reserve the right not to accept returns.
  • It is the customers’ responsibility to ensure all details entered into an order are correct and we will not be responsible for any erroneous order data
  • Where we cannot supply an order or part thereof, we will contact the customer within 48 hours of the issue being identified to discuss how to proceed. In such circumstance we will agree, upon request, to refund the order or part thereof that cannot be supplied, including an allowance for the delivery charges that would have been applied.

Indemnity

By accessing our websites, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

Disclaimers

Whilst we have taken all due care in providing the information on our websites, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.

Limitation of Liability

To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services and/or product/s we have supplied.

Force Majeure

“Force Majeure” means any act, circumstance or omission over which we could not reasonably have exercised control.

If a Force Majeure event causing delay continues for more than 21 days, we may terminate this Agreement, by giving at least 7 days’ notice to you.
